How is it unconstitutional to ban firearms, but constitutional to ban same sex marriage?

Don’t expect Americans to make sense.

There was an issue brought up a few years ago that some factions of the country wanted to make a constitutional amendment to ban same sex marriages, it was shot down and left up to the states to decide. The founding fathers never envisioned the amount of gays in the world – had they I bet there would have been a constitutional mention of it.

Marriage isn’t covered by the Constituion… either pro or con.

It is not within the bounds of authority of the Constitution to ban or allow marriage of any type. It is an issue, by default, left to the states.

Gun ownership is established and protected by the Constituion.

That is why it is unconstitutional to ban guns. There is no constitutional ban on same sex marriage.

I don’t recall seeing anything in the Constitution guaranteeing the right of any individual to marry any other individual.

For that matter, why stop at gay marriage? Why should polygamy be illegal?

Besides being a religious thing, marriage is a government sanction of a union, for the purposes of promoting a healthy society. It’s biological in nature. The gov’t and society want men and women to pair off in a monogamous relationships and procreate and raise families. That obviously is not happening in gay marriages.

Don’t confuse me here. I actually favor gay marriage. I think we as a society will not be harmed at this point if gay people marry each other. But we have to recognize that is not why marriage was instituted.

Someone once said something to me that summed up the issue nicely. If 30 years ago, someone had told you “Marriage is between a man and a woman,” you would have looked at them like they were stupid. Why would they state such an obvious fact?

Well, it certainly raises the question of how something which is identical to marriage can be treated differently from a marriage. Is my marriage to my wife a marriage, or is it identical to marriage as defined by the State, and so unconstitutional? Personally I fell the law should be enforced, all marriages since 2005 revoked, and let the People know just how screwed up it is to deny someone marriage.

Honestly, I don’t care if we allow same sex marriage or not. There are more important things we should be focused on. The 2nd Amendment protects our Right to Bear Arms there’s no Amendment for Gays Right to Marry.

Read the news. The Supreme Court just decided on citizens right to bare arms (based on the Second Amendment right of our US Constitution) in the City of the District of Columbia, and in California, the Supreme Court ruled in favor of same sex marriages.

See, this is how I see it. Why do I have to tolerate same-sex marriage, abortion, animal rights and other choices and lifestyles that I do not agree with but those that do cannot or won’t tolerate my lifestyle of sport shooting, hunting, self defense, conceal carry, etc have a fit because of the 2nd Amendment.

Tolerance…its killing our country. You can do what you want, but I cannot.

And I agree with the first answerer. The 2nd by mention protects the right to bear arms. Not the “right” to same sex garbage.

I do not agree that banning same sex marriage is constitutional, however it is not really spelled out any where specifically.

The second amendment SPECIFICALLY makes gun ownership constitutional.

It’s Not… the government is so screwed up right now we have 435 leaders in the house of reps thinking about 435 different problems and we have a 100 senators trying 100 different things and also we have 1 commandor in cheif who doesn’t know what the f**k he’s doing!!! So really we should just do what the constitution says not what the government says….

Pretty sure the right to same sex marriage is not spelled out in the 2nd Amendment or any other part of the Constitution.
