Car owner vs co buyer?


I have a car under my name my husband is the co buyer we have separated, we agreed on selling the car and going half and half. Since nov he keeps saying he’s been trying to sell it. But he hasn’t put a for sale sign or anything. Since we bought the car we’ve gone half and half on it every month since…

Since you were buyer and co-signer on the vehicle at the time the car was bought, I’m going to assume that both of you are on the title. If this is the case, neither of you has any more right to the vehicle than the other. Even in the case of a divorce, when one person is awarded the car, it would not override the original lien, meaning that if one person went into default, the other person is still responsible for the remainder of the loan.

If you are divorced, you could file for an ex parte order to award the car to you. In addition, have the judge order him to relinquish the vehicle to you. Failure to do so on his part would put him into contempt of of court. He can be arrested, and the police can escort you to pick up the car.

If you are still married, you could attempt to refinance the car in your name only, if you want to keep it. If not, you could sue him in small claims court, and try to have the court compel him to give you the car so that you can sell it. You could also go to local dealerships, and get “buy-bids” for your car. If you can get a offer for at least the amount of the loan, and can come out even, sell it to the dealership and wash your hands of the situation. Good luck…

Its legally your car so go to the police and say your husband wont give you your car back. take your papers just encase also dont expect him to pay half anymore
